The Hearing

If you are suffering from a physical or mental disability that prevents you from being gainfully employed, you may qualify for Social Security disability benefits. Filing for disability benefits is a long and complicated process. While there may not be any way to make the wheels of government move faster, by hiring an Atlanta disability lawyer you can help avoid common mistakes during the application process that can prevent the rejection of your claim or decrease the time it takes for the disability examiner to review your case.

Prehearing Conference

Either the administrative law judge (at the hearing level) or yourAtlantadisability lawyer can request a prehearing conference prior to your administrative law judge (ALJ) hearing. An attorney advisor will review your file, determine if any additional evidence is needed, and conduct an informal conference. The attorney advisor is able to issue a fully favorable decision. If a favorable decision is rendered, the ALJ hearing will be dismissed unless a request to proceed has been issued within 30 days.

ALJ Hearing

A disability hearing is much less informal than a typical court hearing. The hearing is not adversarial in nature. Additionally evidence may be admitted even though it would have been inadmissible in court. In most situations, the ALJ may require the testimony of a medical or vocation expert. YourAtlantadisability lawyer may also present such testimony to present additional information to strengthen your case.

You have choice to either attend the hearing in person or via video teleconferencing. If you prefer not to appear via video, the ALJ is mandated to reschedule the hearing so that you can appear in person.

Upon the conclusion of the hearing, the ALJ will issue a written decision that he or she will give to you either at the hearing or sometime thereafter.
